    NEED TO KNOW
    • Jerry Sandusky, a former Penn State football coach, is accused of raping and molesting children
    • A lot of people on In Session and HLN Facebook pages want to know if Sandusky will testify

As Jerry Sandusky’s defense team prepares to present its case next week, a lot of people are asking whether Sandusky will take the stand.
Ultimately, the decision of whether to testify always falls on the defendant, who, in this case, is on trial for allegedly sexually abusing 10 boys over a period of nearly 15 years. All that Sandusky’s attorneys can do is advise him on what they believe is the best legal strategy. At some point before closing arguments, Judge John Cleland will explain to Sandusky that the decision to testify is solely up to him, and will ask him if his attorney has advised him on the issue. If he decides not to testify, Sandusky will have to state in open court that he chooses to not testify, and he understands the repercussions of not testifying.
In Session’s legal experts say that many attorneys advise against their clients testifying, because it exposes them to the piercing questions the prosecution can raise during cross examination. However, every case is unique, and defense attorneys must weigh the pros and cons for every case.
In Session’s Beth Karas, who is watching the trial from inside the courtroom, is unsure how Sandusky’s defense is leaning on this issue, but she says he may hurt his case if he decides to testify.
"He already hurt himself months ago. The Bob Costas interview gave us some insight to how he handles questions about these allegations. He didn't help himself that day," said Beth Karas.
During the interview on NBC's Rock Center, Costas asked Sandusky if he was sexually attracted to young boys, and Sandusky replied, "I enjoy young people. I love to be around them, but no, I'm not sexually attracted to young boys."
"Sandusky could get on the witness stand and describe all the wonderful things The Second Mile has done for at-risk youths over the years. But he'll then be subjected to a cross examination that may overshadow those good things. It's a risk his attorney may advise against."
